These Terms & Conditions (“Terms”) govern your access to and use of the WinZar mobile application and related services (“WinZar”, “we”, “us”, “our”), owned and operated by Velmora Technologies.
By downloading, accessing, or using WinZar, you acknowledge that you have read, understood, and agree to be bound by these Terms, along with our Privacy Policy, Cookie Policy, and Refund Policy. If you do not agree, you must immediately discontinue use of WinZar.
1. Eligibility
1.1 You must be at least 18 years old to register and participate in WinZar activities. WinZar does not permit usage by minors. Any accounts found to be operated by individuals under 18 will be terminated immediately.
1.2 You must have the legal capacity to enter into binding agreements under applicable laws.
1.3 Users are responsible for ensuring their participation in WinZar is lawful in their jurisdiction.
2. Earning Rewards
2.1 Rewards can be earned by completing eligible activities, including but not limited to surveys, polls, non- real cash games, quizzes, and promotional offers.
2.2 Rewards are awarded in the form of coins/points and can be redeemed for available digital gift cards or vouchers once the minimum redemption threshold is reached.
2.3 Coins/points must be redeemed within 12 months of being credited, failing which they may expire.
2.4 Reward availability may vary depending on geographical location, partner policies, and stock or supply constraints.
2.5 WinZar reserves the right to change reward types, redemption values, and availability without prior notice.
3. User Account & Responsibility
3.1 You are solely responsible for maintaining the confidentiality of your login credentials.
3.2 You agree not to share your account with any other person.
3.3 All activities carried out through your account will be deemed as your own actions.
3.4 If you suspect unauthorized access, you must notify WinZar immediately.
4. User Verification & KYC
4.1 WinZar may require identity verification (KYC) before processing redemptions to comply with fraud prevention measures and applicable laws.
4.2 Failure to provide requested documents may lead to suspension or denial of redemption requests.
5. Fraud Prevention & Prohibited Conduct
The following activities are strictly prohibited and may result in immediate account termination, reward forfeiture, and potential legal action:
a) Submitting false, misleading, or incomplete survey responses.
b) Using automated systems, bots, scripts, or any form of fraudulent participation.
c) Creating multiple accounts to manipulate earnings.
d) Attempting to hack, reverse engineer, or otherwise interfere with the WinZar platform.
e) Violating partner network policies or applicable laws.
6. Suspension & Termination of Accounts
6.1 We reserve the right to suspend, restrict, or terminate any account at our sole discretion, with or without notice, if we believe these Terms have been violated.
6.2 Any rewards, points, or balances in a terminated account will be forfeited.
6.3 We may also suspend accounts for inactivity exceeding 12 consecutive months.
7. Intellectual Property Rights
7.1 All intellectual property, including but not limited to the WinZar brand name, logo, designs, UI/UX, software code, content, and data, is the exclusive property of Velmora Technologies.
7.2 No part of WinZar may be copied, modified, distributed, sold, or used for derivative works without prior written permission from Velmora Technologies.
8. Taxation
8.1 Users are solely responsible for any taxes, duties, or levies applicable to rewards received under local laws.
8.2 WinZar does not deduct, calculate, or manage tax obligations on behalf of users.
9. Limitation of Liability
9.1 WinZar and Velmora Technologies are not liable for:
a) Losses or damages arising from technical issues, delays, or errors in reward processing.
b) Unavailability or expiry of gift cards from third-party partners.
c) User mistakes during redemption (e.g., entering incorrect details).
9.2 To the fullest extent permitted by law, our maximum liability shall not exceed the total value of rewards earned by the user in the three months preceding the claim.
10. Data Security Disclaimer
10.1 While we implement industry-standard security measures, we cannot guarantee complete protection against unauthorized access, hacking, or data breaches.
10.2 Users acknowledge and accept the inherent risks of transmitting data over the internet.
10.3 By using WinZar, you consent to the collection, storage, and processing of your data in accordance with our Privacy Policy.
11. Governing Law & Jurisdiction
11.1 These Terms shall be governed by and construed under the laws of India.
11.2 Any disputes shall be subject to the exclusive jurisdiction of courts located in Indore, India.
12. Force Majeure
12.1 We are not responsible for any failure to perform due to causes beyond our reasonable control, including but not limited to natural disasters, acts of government, internet outages, or partner service interruptions.
13. Dispute Resolution & Arbitration
13.1 In the event of a dispute, the parties agree to first attempt to resolve the matter through negotiation.
13.2 If negotiation fails, disputes shall be referred to binding arbitration under the Arbitration and Conciliation Act, 1996, with proceedings held in Indore, India.
13.3 The arbitration decision shall be final and binding on both parties.
14. Modification of Terms
14.1 We reserve the right to modify these Terms at any time.
14.2 Changes will be effective once posted on our platform. Continued use of WinZar constitutes acceptance of updated Terms.
15. Refund & Cancellation Policy
15.1 All rewards issued in the form of digital gift cards, vouchers, coins, or credits are non-refundable and non-transferable.
15.2 Once a gift card is issued, no cancellation or exchange is permitted.
15.3 If you believe an error occurred during redemption, you must raise a claim within 48 hours by contacting contact@winzar.in.
16. Cookie & Tracking Policy
16.1 WinZar may use SDKs, APIs, cookies, or similar tracking technologies to:
a) Personalize your in-app experience.
b) Track advertisement performance.
c) Improve app functionality and engagement.
16.2 By using WinZar, you consent to such tracking in compliance with applicable laws.
17. Disclaimer
17.1 WinZar is a reward-based entertainment and engagement platform. Earnings depend solely on genuine participation and available partner offers.
17.2 We are not affiliated with Amazon, Flipkart, Paytm, Meesho, or any other brand whose gift cards are offered. They are independent third-party partners.
17.3 The value of coins/points is virtual and has no direct cash equivalent.
17.4 Rewards are subject to availability, location restrictions, and fair usage policies.
17.5 No Real Money Gaming: WinZar does not offer betting, gambling, wagering, fantasy sports, poker, rummy, casino, or any form of real money gaming.
17.6 Free-to-Use: Users are not required to deposit or stake money to participate in any activity on WinZar.
17.7 Reward System: Rewards are earned only through completing legitimate surveys, offers, and tasks provided by trusted partners. These rewards can be redeemed through supported methods such as gift cards, vouchers, or wallet transfers.
17.8 Compliance: WinZar operates under the applicable Indian laws and is fully compliant with recent government regulations banning real money gaming.
17.9 Entertainment & Utility Only: The platform is strictly for engagement, entertainment, and market research purposes — not for gambling or gaming with money.
17.10 WinZar is not responsible for the content, availability, or accuracy of surveys, tasks, or offers provided by third-party partners.
17.11 The App may contain links of third-party websites or aps. We are not responsible for the privacy practices or content of such external sites. Users need not to pay for anything and this is clearly recommended not to pay anything. Users may find some platforms under task or game which may auto-reflect in the app due to integration with other plate-forms, where users may be asked for deposit minimum amount for getting rewarded or may be asked to purchase subscription to get rewarded. We highly recommend not to pay a single penny anywhere and if users pay for anything this will be their personal choice and they themselves will be sole responsible. We will not be able to accept any claim in leu of this and we will not be responsible.
